Ernest Kumi appeals contempt conviction at Supreme Court

Ernest Yaw Kumi, the Member of Parliament for Akwatia, has filed a motion at the Supreme Court, seeking to overturn his February 19 contempt of court conviction. Mr.Kumi, who was found guilty by Justice Emmanuel Senyo Amadehe of the Koforidua High Court, is contesting the ruling, arguing that the judge made significant legal errors.

Mr.Kumi’s legal team, led by Gary Nimako Marfo, claims that the court assumed jurisdiction in the Parliamentary Election Petition related to the Akwatia Constituency before the Electoral Commission had published the official Gazette notification of the results. The application further argues that the High Court judge violated the rules of natural justice by proceeding with the contempt application while a motion to set it aside was still pending.

Mr. Kumi was convicted for defying an interim injunction that prevented him from being sworn in as a legislator. However, his legal team also accuses the judge of bias, claiming that Justice Amadehe denied them a hearing because they hadn’t filed an ‘Appearance’ in the contempt application.

The MP is asking the Supreme Court to declare the election petition that led to his conviction as incompetent, arguing it was filed without the necessary Gazette Notification. He is also seeking the quashing of the contempt ruling and the bench warrant issued by the High Court.

The Supreme Court has not yet set a date for hearing the application.
