A Sekondi High Court has cleared Joana Gyan Cudjoe, the National Democratic Congress (NDC) parliamentary candidate for Amenfi Central, to contest in Ghana’s upcoming general election after vacating an injunction that had blocked her candidacy.
The decision, delivered by Justice Gyan Konto on November 11, allows her name and photo to appear on the ballot for the December 7 elections. The ruling follows weeks of legal contention over her eligibility, with five plaintiffs initially seeking an injunction against her candidacy.
The plaintiffs argued that Gyan Cudjoe, who faces allegations surrounding her eligibility, should be disqualified from contesting. However, after failed attempts at an out-of-court settlement, both parties presented arguments in court. Lawyers for the plaintiffs claimed Gyan Cudjoe’s eligibility was still in question, but their request to prevent her appearance on the ballot was dismissed.
The NDC, as a second defendant, supported Gyan Cudjoe, with legal representatives arguing that the party’s internal processes align with public electoral guidelines. Party representatives, including Isaac Adjei Mensah, the MP for Wassa East, and several regional and national executives, attended the hearing to show support for the candidate.
With the injunction lifted, the Electoral Commission has been directed to add Gyan Cudjoe’s name to the ballot. Her lawyer, Edudzi Kudzo Tamakloe, emphasized that the Commission should comply with the ruling immediately, enabling her to contest in Amenfi Central on December 7.
This latest development underscores the strong backing Gyan Cudjoe enjoys within the NDC, despite recent controversies, as she prepares for the election next month.
