NDC Objects to Swearing-in of Patrick Boamah,2 others

A member of the National Democratic Congress (NDC) legal team has raised objections to the swearing-in of three New Patriotic Party (NPP) Members of Parliament-elect, citing alleged legal and procedural irregularities.

Justice Srem Sai, speaking on the Citi Breakfast Show on Monday, January 6, argued that the process leading to the declaration of Patrick Yaw Boamah (Okaikwei Central), Charles Forson (Tema Central), and Martin Adjei Mensah Korsah (Techiman South) as winners was flawed.

The three MPs were declared victors following a re-collation of results ordered by the High Court. However, Sai contended that the legal dispute over the validity of this process had not been fully resolved, as the NDC had filed an appeal for a stay of execution against the court order.

He pointed out that this appeal had been formally served on the Electoral Commission (EC), putting the re-collation process under judicial review. Sai argued that the re-collation could not proceed lawfully while the appeal was pending.

“I do not see why someone would say the swearing-in will happen,” Sai said. “Once a notice of a stay application has been served, you cannot lawfully conduct the re-collation. If you continue, it would be a breach of the court’s orders.”

He called for the swearing-in of the three MPs to be postponed until the legal challenges surrounding their election were resolved.
