Ofori-Atta sues OSP again over ‘Wanted Person’ label

Former  Finance Minister Ken Ofori-Atta has initiated legal proceedings against the Office of the Special Prosecutor (OSP) over its continued classification of him as a “wanted person” in connection with ongoing investigations. In a motion filed in court, Ofori-Atta seeks to prevent the OSP from publicly identifying him as a “fugitive from justice,” a designation he argues is both misleading and unlawful.

Mr. Ofori-Atta contends that the OSP’s actions, including the persistent display of his photograph and personal information on its official social media accounts, violate fundamental principles of administrative justice. He points to a February 18, 2025 letter from the OSP, which he asserts promised the removal of his name from the agency’s wanted list. Despite these assurances, the former finance minister claims that the OSP has not followed through.

The lawsuit requests that the court issue an immediate injunction to halt any further public statements or press releases labeling Ofori-Atta as a fugitive. In addition, Ofori-Atta’s legal team is seeking a court order compelling the agency to erase all references to him as a wanted individual across its platforms.

Mr. Ofori-Atta argues that the OSP’s actions infringe upon his constitutional rights, including his freedom of movement, personal liberty, and access to administrative justice. His legal team asserts that the continued public characterization as a fugitive constitutes a violation of Ghana’s 1992 Constitution.

The case, which marks a significant escalation in the conflict between Ofori-Atta and the OSP, is scheduled for hearing in April 2025. If successful, the injunction would prevent the Special Prosecutor from making any further public statements regarding Ofori-Atta’s legal status until a final court ruling is issued.
