Vincent Ekow Assafuah, the Member of Parliament for Old Tafo, has filed a lawsuit at the Supreme Court to prevent President John Dramani Mahama from initiating the removal process of Chief Justice Gertrude Araba Esaaba Sackey Torkornoo.
Mr. Assafuah argues that the President’s actions violate constitutional provisions and threaten the independence of the judiciary. He claims that under the Constitution, the President must first notify the Chief Justice and seek her comments before referring any petition for her removal to the Council of State.
The MP contends that failure to follow this procedure undermines judicial independence and violates the Chief Justice’s right to a fair hearing. He is seeking a declaration from the Supreme Court that the President must adhere to these requirements, and that any process initiated without consulting the Chief Justice should be considered invalid.
The case highlights concerns about executive overreach and the importance of protecting the separation of powers in Ghana’s governance. The Attorney General is expected to respond within 14 days, with the court to decide on the next steps thereafter.
