“No one can force Chief Justice to Resign” – Godfred Dame

Former Attorney General and current lawyer for suspended Chief Justice Gertrude Araba Torkornoo has criticised the ongoing removal proceedings against her, describing them as constitutionally flawed.

Speaking to reporters outside the Supreme Court in Accra on Wednesday, Godfred Dame said due process and the rule of law were being undermined in the handling of the case. His comments followed the Court’s unanimous dismissal of an injunction application filed by the Chief Justice, seeking to halt the work of a five-member committee investigating three separate petitions for her removal.

Earlier in the day, the Court had also unanimously struck out her supplementary affidavit.

Despite mounting calls from some quarters for Justice Torkornoo to resign in the face of multiple legal setbacks, Dame was adamant that resignation was not an option.

“No one can force the Chief Justice to resign,” he said. “The most important thing is that the rule of law, constitutionalism, and due process must prevail. That is what she is seeking.”

Justice Torkornoo, who has been suspended pending the outcome of the proceedings, continues to contest the legitimacy of the process being used to determine her fate.
