Ghana’s Judicial Service Reminds Judges: Attempted Suicide Decriminalised

The Judicial Service of Ghana has issued a formal reminder to all judges and magistrates, clarifying that attempted suicide is no longer a criminal offence. This follows the passage of the Criminal Offences Amendment Act, 2023.

In a letter dated 18 October 2024, Judicial Secretary Justice Cyra Pamela Koranteng reminded circuit court judges and magistrates that individuals who attempt suicide should no longer face prosecution or conviction. The letter emphasized the amendment of Section 57 of the Criminal Offences Act, 1960 (Act 29), and Section 95 of the Mental Health Act, 2012 (Act 546), brought about by Act 1092.

“Circuit court judges and magistrates are to take note for compliance,” the statement stressed.

Parliament passed the amendment in June 2023, officially decriminalising attempted suicide. Under the new law, those who attempt suicide will receive mental health care and support instead of facing imprisonment.
