Speaker Bagbin Challenges Supreme Court’s Ruling on Parliamentary Seat Vacancies

Lawyers for Ghana’s Speaker of Parliament, Alban Bagbin, have petitioned the Supreme Court to overturn a recent ruling that temporarily halted his declaration of four parliamentary seats as vacant.

The Speaker’s legal team argues that the Supreme Court does not have jurisdiction in the case, which was originally filed by Effutu MP, Alexander Afenyo-Markin.

In the application, filed by lawyer Thaddeus Sory of Sory @ Law, the Speaker’s counsel is seeking an order to dismiss the Supreme Court proceedings related to the matter and to vacate the Court’s October 18 directive. “This Honourable Court shall be moved…praying the Court for an order: i. setting aside the processes and proceedings in the Supreme Court in this suit. ii. vacating the order of the Court dated 18th October 2024,” the application reads.

On October 18, the Supreme Court had directed Parliament to allow the four MPs to retain their seats while the legal challenge proceeds, following the Speaker’s initial declaration of their seats as vacant on October 17. The ruling has intensified the existing tension in Parliament, where both sides currently claim to hold a majority.
