Samuel Aboagye, the declared winner of the Obuasi East parliamentary seat, has filed a judicial review application at the Accra High Court, challenging the Electoral Commission (EC) of Ghana over its handling of the election results.
Aboagye is contesting the EC’s decision to conduct a second collation and declaration of the election results on December 21, 2024, claiming the process involved irregularities. The suit, filed by Aboagye’s lawyer Elikplim L. Agbemava, names the EC and Patrick Boakye Yiadom, another candidate, as the interested parties.
Aboagye is seeking the court to:
Declare the second collation and declaration of results null and void.
Order the EC to gazette the original results from December 8, 2024, which Aboagye argues declared him the winner based on Form 1D, signed by all parties.
Issue an injunction preventing the EC from publishing any conflicting results.
Prevent Patrick Boakye Yiadom from assuming the role of Obuasi East MP.
In his application, Aboagye asserts that the Public Elections Regulations, 2020 (C.I. 127) do not allow for a second collation or declaration after the official announcement. He also contends that the results outlined in Form 1D are binding and cannot be changed without the consent of all candidates involved.
Aboagye, who was initially declared the winner of the December 7 election, argues that any challenges to the results should follow the appropriate legal procedures.
The case will be heard by the General Jurisdiction Court Two tomorrow.
