The Supreme Court is set to hear a case on April 9, 2025, challenging the process for potentially removing Chief Justice Gertrude Torkornoo from office.

The suit, filed by Vincent Ekow Assafuah, the Member of Parliament for Old Tafo, questions the constitutional procedure followed by President John Mahama after receiving three petitions calling for the Chief Justice’s removal. Assafuah is seeking a ruling that the Chief Justice should be allowed to respond to the allegations before the President can consult with the Council of State under Article 146(6) of the 1992 Constitution.

Mr. Assafuah, represented by former Attorney-General Godfred Dame, argues that failing to notify the Chief Justice violates her right to a fair hearing and threatens judicial independence.

The case will examine whether the President’s actions align with the constitutional framework for removing a sitting Chief Justice.
