Ghana’s former Chief Justice, Gertrude Torkornoo, has filed a lawsuit seeking to stop the parliamentary vetting of Justice Baffoe-Bonnie, who has been nominated as her successor.
The legal action, brought before the High Court in Accra, challenges the legitimacy of the process that led to her removal from office and seeks to nullify the Presidential Warrant issued by President John Mahama on 1 September.
Justice Torkornoo argues that the committee that investigated her — chaired by Justice Gabriel Scott Pwamang — acted unconstitutionally. She wants all decisions made by the committee, including its report and subsequent presidential actions, declared null and void.
Justice Torkornoo was dismissed after the committee found her guilty of misconduct, including the misuse of public funds and violations of constitutional provisions. The findings were submitted in accordance with Article 146 of Ghana’s Constitution, which outlines procedures for removing judges of the superior courts. The Council of State was also consulted as part of the process.
Justice Baffoe-Bonnie, who has served as Acting Chief Justice since April following Torkornoo’s suspension, was nominated last month by the President to take on the role permanently. His vetting by Parliament’s Appointments Committee is expected to take place soon.
